Charges filed in shooting of off-duty officer during robbery attempt CHICAGO -- Charges were filed Tuesday night in the shooting of an off-duty police officer during a robbery attempt. Samuel Harviley, 25, is charged with attempted murder. Police say Harviley shot 49-year-old Stephen Boyd in the leg while the officer was parking his car in the Washington Heights neighborhood. Two other suspects got away. Investigators said Officer Boyd was parking his vehicle after work near West 101st and South Green streets around 2:20 a.m. Monday when two armed men walked up to the vehicle. The officer was in civilian clothes, so it's likely the two men who approached him and demanded money had no idea he was an off-duty officer who was carrying a gun. One robber stood next to the driver's side window and the other stood next to the passenger's side window and ordered Boyd to get out of the car and hand over money. A third man was waiting in a getaway car, police say. Boyd was shot in the right leg, but was able to return fire. Police said it is unclear whether either of the suspects was hit before they ran from the scene. Police are combing through area hospitals trying to find people that may have been shot. The 49-year-old officer was rushed in critical condition to Advocate Christ Medical Center and is expected to survive. |

(Pointy-headed black) Man convicted of 1977 murder (of White man) given new sentence OMAHA, Neb. - A man sentenced to life in prison for murder was given a new sentence on Monday. Fifty-three-year-old Kelvin Anderson was only 15-years-old when he shot and killed Robert McGinnis during a robbery in 1977. On Monday, Anderson was resentenced to 82-100 years and will be eligible for parole in three years. He will be eligible for release in 11-12 years. Anderson had hope after serving 38 years of his life sentence. His attorney argued that Anderson had not intended to use the gun with McGinnis was murdered. He took a guilty plea to save his older brother from a life in prison or the electric chair. Attorneys argued that Anderson was mentally low-functioning. The prosecution argued that he had been involved in other criminal activity and, at the time of the homicide, he had escaped from the Iowa juvenile system. Prosecutors also argued that Anderson knew they were going to commit a robbery and that he took the gun. District Judge Mark Ashford said this case was "a robbery and an assassination" before resentencing Anderson to 82-100 years. Family members of the man killed said otherwise. Charles McGinnis, the brother of the homicide victim, said, "They should have left it as it stands. It was a murder assassination robbery." Anderson headed back to prison after the resentencing on Monday, but the victim's family could go through these painful memories again in three years when Anderson is up for parole. A 2013 U.S Supreme Court decision mandated it's unconstitutional for juveniles to receive mandatory life sentences without parole. - (Black-on-white) |

(Black) Double cop killer taken off death row An unrepentant gang member on death row for killing two NYPD officers scored a stunning reprieve Tuesday when a federal judge ruled he was too “intellectually disabled” to be executed. Ronell Wilson “has demonstrated significantly subaverage intellectual functioning” that legally exempts him from capital punishment, Brooklyn Judge Nicholas Garaufis wrote. Garaufis accepted defense claims that Wilson was “intellectually disabled,” which the judge called the “accepted terminology” for what used to be called “mentally retarded.” “These deficits arose during Wilson’s developmental period, and they persisted through the time of the crime,” Garaufis wrote. Garaufis then resentenced Wilson, 33, to life in prison for the 2003 murders of undercover Detectives James Nemorin and Rodney Andrews during a gun buy-and-bust operation on Staten Island. |

Austin police to fire (black) officer who shot, killed (black) nude teen AUSTIN, Texas – An Austin police officer who fatally shot an unarmed, naked 17-year-old last month will be fired, Police Chief Art Acevedo announced Monday. In a memo outlining the disciplinary action, Acevedo said Officer Geoffrey Freeman violated department policy in the shooting of David Joseph -- that he should not have confronted the teenager alone, that his decision to draw his weapon wasn't warranted and that there were other ways he could have stopped Joseph after the teen began charging at the officer. Freeman's lawyers with the Combined Law Enforcement Associations of Texas say they will appeal. The general counsel for the group has said Freeman feared for his life when he fired his gun at Joseph. |

Black Sports: Darren Sharper likely to get 15-20 years under new plea deal in serial rape cases - over at least three states NEW ORLEANS -- A federal judge Tuesday formally accepted Darren Sharper's plea deal in a drug and rape case, making clear to the former NFL star that she could sentence him to 20 years in prison. U.S. District Judge Jane Triche Milazzo had earlier rejected a deal that could have meant a nine-year sentence. Attorneys say federal sentencing guidelines call for a sentence in the range of roughly 15 or 16 to 20 years. Prosecutors said in court Tuesday that they may recommend a lighter sentence, based on Sharper's cooperation in related cases. Sentencing was set for June 16. In addition to his federal guilty plea, Sharper has pleaded guilty or no-contest in state courts to charges that he drugged and sexually assaulted women in Arizona, California, and Louisiana. Those charges involve nine victims, but Milazzo said in court earlier this month that there may be as many as 16. Sharper has been sentenced to nine years in Arizona but still awaits formal sentencing in Los Angeles, Las Vegas and in state and federal courts in New Orleans. - (Black Sports) |
