Group wants 2 Supreme Court justices removed after Carr sentences overturned WICHITA, KS - It was a brutal crime that rocked the city of Wichita and has gone down as one of the worst crimes in state history. Fourteen years ago, two brothers were accused of going on a crime spree of murder, assault, rape and robbery, killing five people in the brutal attacks. Two years later, Reginald and Jonathan Carr were tried, convicted and sentenced to death, but recently the Kansas Supreme Court overturned their death penalty sentences and some convictions. Now there is a movement to have two Supreme Court justices removed from the bench following their decision on the case. "Took our breathe away. We were all completely shocked and devastated again that it felt like we were going back to that day," Amy James said. That day for James dates back to December 2000 and is considered one of the worst in the history of Kansas as the Carr brothers wrapped up the brutal crime spree. Brad Heyka was one of five victims who were assaulted, tortured and taken to a frozen field where they were shot execution style and run over with a truck. The Carr brothers were convicted of capital murder and sentenced to death. But 14 years after their murderous spree, the Kansas Supreme Court overturned their death penalties, stating the trial judge should have separated their penalty proceeding. Several convictions were also overturned. James and other victims' family members were at the Kansas Supreme Court when the appeal arguments were being heard last December. “What really upset me was how the justices talked about it like they were talking about the weather. They were very arrogant," she said. With the six-to-one ruling to overturn the death penalty, the family and friends have formed the group Kansans for Justice. They are urging voters not to retain Kansas Supreme Court Justices Eric Rosen and Lee Johnson in the Nov. 4 election. "Help us remove those two justices so that we can hopefully put new people in place who will move cases along," James said. James said putting the surviving victim through another trial is criminal itself and believes it's time to focus on the victims who lost their lives and not the monsters who took them. - (Black-on-white) |

(Bleeding) Kansas court overturns black killer-rapist brothers' death sentences - Jul 25, 2014 TOPEKA, KS - The Kansas Supreme Court on Friday overturned the death sentences of two brothers convicted of capital murder in a crime spree in Wichita in 2000 including robbery, rape, forced sex and four fatal shootings in a snow-covered soccer field. The court also struck down three of the four capital murder convictions each against Jonathan and Reginald Carr. It upheld one capital murder conviction for each of them. Their cases will return to Sedgwick County District Court for further hearings. The court's majority overturned their death sentences because the presiding judge did not hold separate proceedings for each man. In overturning most of their capital convictions, the majority said the instructions to jurors were flawed. The justices on Friday issued a separate ruling for each brother. The Carr brothers' crimes are among the most notorious in the state. The victims in the December 2000 attacks that culminated in a bloody scene in a snowy field were: Aaron Sander, 29; Brad Heyka, 27; Jason Befort, 26; and Heather Muller, 25. Another woman who was shot in the head survived and ran naked through the snow to seek help, becoming a key witness at the brothers' trial. Prosecutors said the five friends were in a Wichita home when two armed intruders forced them to engage in sex with each other and later made them withdraw money from automatic teller machines. The two women were raped repeatedly before the five were taken to the soccer field and shot while they were kneeling. The Carr brothers also were convicted of first-degree murder in connection with the fatal shooting of a 55-year-old cellist, Ann Walenta of Wichita, only days before the spree that left four dead. Jonathan Carr, now 34, and Reginald Carr, 36, were in their early 20s when the crimes occurred. Together, they were convicted of 93 crimes, including rape, aggravated kidnapping and aggravated robbery and sentenced to death. of Carr Victim Sues State Carr Mistakenly Released From Jail Before Murder Spree WICHITA, Kan. -- The husband of a slain Wichita woman is suing the state, claiming it negligently paroled the man who later killed his wife. Don Walenta filed the lawsuit Monday in Sedgwick County District Court. His lawsuit comes three weeks after Reginald Carr and his brother, Jonathan Carr, were convicted of murdering Ann Walenta and four others during a December 2000 crime spree. The brothers received the death penalty. After Carr trial, EMS explains response - victim was breathing more than two hours
after shot EMS officials eventually decided to treat and transport the victim -- who suffered a clearly fatal head wound -- because the body continued to take shallow, intermittent breaths. It was the type of breathing that experts say is a reflex of a dead body, not a sign of life. Still, Lamkey said, the coroner declined to certify the victim as dead because the irregular breathing continued. Trauma victims sometimes show agonal respiration, but usually it lasts only five to 10 minutes, said Dan Caliendo, a Wichita emergency room doctor. But the irregular breathing had persisted for more than two hours by the time Dudley arrived, and because of it, she could not certify that the person was dead, Lamkey said. |

Wichita: Carr brothers sentenced to death Reginald and Jonathan Carr this afternoon were both sentenced to death for four murders in Wichita in December 2000. The jury in the Carr capital murder trial, which last week convicted the two men of the murders and of a long list of other crimes, agreed that both men should be executed for the capital murders. The two will be sentenced by Judge Paul Clark tomorrow on the remaining charges. |

Planned - Wichita - KAKE News The National Socialist Movement could be coming to Wichita to protest the Carr brothers' murder trial. The controversial group is asking the city for a protest permit. Last summer, leaders of the National Socialist Movement met in Topeka to protest the Carr trial. They believe the five murders should be classified as hate crimes because the Carr brothers are black and the victims were white. The group says the Carr brothers should be put to death. The national socialist movement has asked the city for permits to rally at Riverside Park and downtown Wichita on December 15th, the anniversary of the Carr brothers' crimes. NAACP leaders say they will hold a counter rally if the national socialist movement comes to Wichita. The Wichita Police Department confirms the group is asking for a permit to protest. If the group does come to Wichita, police say they will monitor the event. City leaders have yet to decide if the group should be allowed a formal protest. |

The brothers, who now face the death penalty, were found guilty of killing four people in a soccer field near K-96 and Greenwich Road in December 2000. They also were found guilty of first-degree murder in the death of Ann Walenta. Reginald Carr was also found guilty in the kidnapping and robbery in the carjacking of Andrew Schreiber, but Johnathan Carr was found not guilty in that crime. The Carrs also were found guilty of attempted first degree murder against the woman who survived the attack in the soccer field. She testified against the brothers during the trial, which lasted eight weeks. The Carr brothers also were found guilty on numerous charges of rape, aggravated robbery, burglary and theft. - BY RON SYLVESTER - The Wichita Eagle "The crimes charged in the Carr case are gruesome." Dudley found bruises on the bodies of Sander, Heyka and Befort. She said red ridges suggested those injuries came from a golf club -- a driver with a wooden head -- found in the triplex where the men lived. The post-mortem exam on Muller, Dudley said, showed injuries consistent with a sexual assault. At the request of police, Dudley also performed an autopsy on a pet schnauzer that belonged to the survivor of the Dec. 15 quadruple homicide. Stephanie Donley (pictured at right) talks about her (sex) life with Reginald Carr during his murder trial in District Court. Carr was arrested in her apartment. Stephanie Donley, who testified Thursday, said she met "Reggie" Carr at a nightclub in Dodge City in October 2000. She said she recognized the presence of the STD when they began seeing each other several weeks later. Carr would stay at her apartment at 5400 E. 21st St. when she wasn't working the night shift as a nurse at a Wichita hospital.
