Blacks charged in killing of retired Birmingham firefighter, Vietnam vet over 'trinkets' are criminal predators, police say HUEYTOWN, Alabama - The slaying of a retired Birmingham firefighter and two-tour Vietnam veteran gunned down during a break-in at his Hueytown home earlier this month was tragic and senseless, said those charged with solving the crime. "This case is not just an outrage for Mr. McKee's neighbors, or just for the citizens of Hueytown or even those in the Birmingham metro area,'' said Hueytown Police Chief Chuck Hagler. "It's the kind of offense that should evoke a reaction from all decent, hardworking people everywhere." Authorities on Friday announced capital murder charges against two men in the April 23 slaying of 66-year-old Howard Arthur McKee. Kamal Potts, 23, was taken into custody into custody Wednesday by Hueytown police and the Birmingham Police Department's Crime Reduction Team. Romel Cunningham, 28, turned himself into authorities in Bessemer midday Friday after he became aware of an all-night search by U.S. Marshals to find him. Rejecting 'retarded' label could cost accused black killer his life John Deloney is insulted by a legal definition and won't use it even though it could save his life. "Let's go ahead and start the trial with the death penalty. That's what I want," Deloney told Hamilton County Common Pleas Court Judge Ethna Cooper in a Friday hearing. Deloney, accused of shooting a Hartwell pizzeria owner to death during a June 15 robbery, is upset that his attorneys are trying to prove he's what Ohio law calls "mentally retarded." While many find the term offensive, "mentally retarded" in Ohio law is defined as having an IQ under 70. That could be a lifesaver for Deloney because in Ohio those declared mentally retarded are ineligible for the death penalty. Prosecutors are seeking the death penalty against Deloney, accusing him of using a gun to rob Richard Evans, the owner of Cosmic Pizza, and then shoot him as Evans ran away. Evans died minutes later in the front yard of the pizzeria in his wife's arms. - (Black-on-white) |

The court didn’t comment on the strength or weakness of Davontae Sanford’s case. It said he couldn’t scratch his guilty plea because there’s no sign that the procedure in Wayne County Circuit Court was faulty. It’s an extraordinary case. Sanford, now 21, is in prison for the fatal shootings of four people at a Detroit drug den in 2007, but he’s been trying to undo his guilty plea for more than five years. |

Oklahoma execution: Clayton Lockett writhes on gurney in botched procedure
The state of Oklahoma botched one execution and was forced to call off another on Tuesday when a disputed cocktail of drugs failed to kill a condemned prisoner who was left writhing on the gurney. After the failure of a 20-minute attempt to execute him, Clayton Lockett was left to die of a heart attack in the execution chamber at the Oklahoma state penitentiary in McAlester. A lawyer said Lockett had effectively been "tortured to death". For three minutes after the first drugs were delivered Lockett struggled violently, groaned and writhed, lifting his shoulders and head from the gurney. Some 16 minutes after the execution began, and without Lockett being declared dead, the blinds separating the chamber from the viewing room were closed. The process was called off shortly afterwards. Lockett died 43 minutes after the first executions drugs were adminsitered. The execution of Charles Warner, scheduled for 8pm local time, was then postponed. Both were due to have been carried out with a drug cocktail using dosages never before tried in American executions. Lockett, 38, was convicted of the killing of 19-year-old, Stephanie Neiman, in 1999. She was shot and buried alive. Lockett was also convicted of raping her friend in the violent home invasion that lead to Neiman's death. - (Black-on-white) |

(Black) Driver Charged After Striking (White) Teen In Police Chase ABERDEEN, Md. — A sixteen-year-old narrowly avoided death when he was struck by a car fleeing police in Harford County. It was a bizarre police chase. The suspect’s vehicle hit a teen and at least two other cars trying to get away. That teen, Joseph Paramore, knows his injuries could have been a lot worse. “Pretty lucky,” he said. Fresh out of the hospital and laid up in bed with a broken femur, scrapes on his hand and crutches by his side, Paramore is in a little pain but remembers everything that happened Sunday night as he rode his skateboard home from a friend’s house. That’s when a car being chased by Aberdeen police came flying down the normally quiet Edmund Street, right by Paramore. “I hear sirens and then I turn around and I see a car and I see him swerving,” he said. “I get hit, I go in the air, I roll a few times and somehow I end up on the grass.” Aberdeen police say it started when officers tried to stop 31-year-old Asim Lievers for speeding along Route 7. The chase passed behind Wal-Mart and eventually into Paramore’s neighborhood. After striking him, the car kept going. “The pursuing officer continued and one officer who was in the area with her stopped and rendered aid,” said Fred Budnick, Aberdeen police. As the pursuit continued, the suspect’s car struck a police car and then hit another vehicle, injuring its one passenger, before Lievers was finally arrested. - (Black-on-white) |
